By using our Site or Services, you agree to the practices described in this Privacy Policy.

Information we process on behalf of our customers. In providing our Services, we process data that our customers (“Clients”) submit to our platform or instruct us to collect on their behalf, which may include their end users' email addresses, behavioral data, purchase history, and engagement metrics (“Client Data”). Our use of Client Data is governed by our agreements with each Client (such as our Master Service Agreement or Data Processing Agreement) and is strictly limited to providing the Services. We do not sell Client Data, use it for our own marketing purposes, or share it with third parties except as necessary to deliver the Services. This Privacy Policy does not apply to Client Data except as described in those agreements.
2. How We Use Your Information
We use information we collect about visitors to our Site and users of our Services for the following purposes:
- To provide, operate, maintain, and improve our Site and Services
- To communicate with you, including responding to inquiries, sending service-related notices, and contacting you about our products and services
- To analyze usage trends and measure the effectiveness of our Site

Service providers and marketing partners. We share information with third-party vendors who perform services on our behalf, such as cloud hosting (Amazon Web Services, Google Cloud Platform), analytics, visitor identification (Retention.com), and communication tools. These providers are contractually required to use personal information only as necessary to provide services to us and in accordance with applicable law.
Advertising and visitor identification. As described in Section 1, we use visitor identification technology on our Site that may constitute “sharing” of personal information for purposes of cross-context behavioral advertising under the California Consumer Privacy Act. You may opt out of this sharing as described in Section 6 below.
Legal requirements. We may disclose information if required to do so by law, regulation, legal process, or governmental request.
Business transfers. In connection with a merger, acquisition, reorganization, or sale of assets, personal information may be transferred as part of the transaction.

Neon Blue maintains a SOC 2 Type II attestation, and details of our security program are available upon request. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.
6. Your Rights Under the California Consumer Privacy Act (CCPA)
If you are a California resident, you have the following rights under the CCPA:
Right to Know. You may request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources, the business purpose for collecting it, and the categories of third parties with whom we share it.
Right to Delete. You may request that we delete personal information we have collected from you, subject to certain exceptions.
Right to Correct. You may request that we correct inaccurate personal information we maintain about you.
Right to Opt-Out of Sale or Sharing. Neon Blue does not sell personal information for monetary consideration. However, our use of visitor identification technology (Retention.com) on our Site may constitute “sharing” of personal information for cross-context behavioral advertising under the CCPA. Right to Non-Discrimination. We will not discriminate against you for exercising any of your CCPA rights.

Categories of personal information collected: Identifiers (name, email address, IP address), internet or network activity information (browsing history, interactions with our Site), and professional information (company name, job title).
Categories of sources: Directly from you, automatically through your use of our Site, and from third-party visitor identification services.
Business purpose for collection: To operate and improve our Site and Services, communicate with you, and market our products.
Categories of third parties with whom we share personal information: Cloud hosting providers, analytics providers, visitor identification services, and communication tools.
Personal information sold: None.
Personal information shared for cross-context behavioral advertising: Identifiers and internet activity information shared with Retention.com for visitor identification purposes on our Site only.

Where we process personal information of individuals in the EEA, UK, or Switzerland, we rely on the following legal bases: (a) legitimate interests, including website analytics, security monitoring, business-to-business marketing communications, and operation of our Services, where those interests are not overridden by your data protection rights; (b) performance of a contract, where processing is necessary to provide requested Services or respond to your inquiries; and (c) compliance with legal obligations.
Where we process personal information on behalf of our Clients as a data processor, we will direct any individual rights requests to the applicable Client, who is the data controller.
8. International Data Transfers
Neon Blue is based in the United States. Information we collect through our Site and Services may be transferred to and processed in the United States or other jurisdictions where our service providers operate. These transfers are necessary to provide our Services and operate our business. Where personal information is transferred from the EEA, UK, or Switzerland to a jurisdiction that has not received an adequacy determination, we rely on legally recognized transfer mechanisms to protect your information.
Retention.com's visitor identification technology operates only for visitors located in the United States and does not process data from individuals in the EEA, UK, or Switzerland.
9. Cookies and Tracking Technologies
We use cookies, pixel tags, and similar tracking technologies to collect information and improve our Site. These may include technologies operated by third-party services such as Retention.com.
